These Terms & Conditions apply to consumer commissions placed with Brambelo.
Please read them before confirming a commission.
1. About Brambelo
Brambelo is the trading name of Gail Astley-Gorman, a sole trader based in England, creating individually commissioned handcrafted family heirlooms.

2. Birth Bear commissions
Brambelo Birth Bears are individually handcrafted and personalised using details supplied for the commission.
A Birth Bear commission includes:
- an individually handcrafted Brambelo Birth Bear;
- weighting to reflect the baby's recorded birth weight;
- personalisation using their arrival details;
- a personalised Brambelo Birth Certificate; and
- a Brambelo presentation box.
Any additional options or enhancements will be agreed separately before additional charges are incurred.
3. Enquiries
Sending an enquiry does not commit you to purchasing a Birth Bear and does not require payment.
Brambelo will respond personally to discuss availability, the proposed commission and what happens next.
4. Placing your commission
Brambelo will agree the commission details and total price with you before you commit.
Any commissioning payment required to secure the commission will be confirmed before the commission begins.
The remaining balance will be confirmed and is payable when the Birth Bear is completed and before dispatch.
Where additional options have been agreed, the final balance will reflect the agreed total price.
No finished commission will be dispatched until the amount due has been paid in full.
5. Personalisation approval and production
Before production begins, you will be asked to provide and approve the personalisation information required for your Birth Bear.
This may include the child's name, date of birth, time of birth, birth weight and other agreed details.
You are responsible for checking that the information you approve is accurate.
Production begins after the required personalisation details have been approved.
If you discover an error after approval, contact Brambelo immediately. We will try to accommodate changes where reasonably possible, but once production has begun some changes may not be possible or may involve additional work and cost. Any additional charge will be discussed with you before that work is undertaken.
6. Handmade nature
Every Brambelo Birth Bear is made individually by hand.
Small variations associated with handcrafted work are part of the character of an individually made product and do not mean that a product is faulty.
This does not affect your statutory rights where goods are faulty, not as described or otherwise fail to meet the standards required by law.
7. Timescales
Because each Birth Bear is individually commissioned and handcrafted, completion times may vary.
Brambelo will provide the current estimated timescale before you commit to the commission.
Any completion or delivery date provided will be treated in accordance with applicable consumer law. If circumstances arise that may materially affect the expected timing, Brambelo will contact you as soon as reasonably possible.
8. Cancellation and personalised goods
Please consider your commission carefully before approving personalisation and production.
Birth Bears are individually made and personalised using information supplied specifically for the recipient. Once production has begun on a genuinely personalised commission, the statutory change-of-mind cancellation right that normally applies to many distance contracts may not apply.
If you wish to cancel before production begins, contact Brambelo as soon as possible.
Where cancellation is permitted, any amount retained from a commissioning payment will be limited to what Brambelo is lawfully entitled to retain, taking account of work undertaken, costs incurred and losses directly resulting from the cancellation.
Nothing in these terms affects any cancellation or refund right you have where Brambelo is at fault or where applicable law gives you such a right.
9. Problems with your order
If your Birth Bear arrives damaged, is faulty or is materially different from what was agreed, please contact Brambelo promptly at gail@brambelo.co.uk.
Brambelo will work with you to resolve the matter in accordance with your statutory consumer rights.
Nothing in these Terms & Conditions excludes or restricts rights that cannot lawfully be excluded or restricted.
10. Delivery
Delivery arrangements, destination and any applicable delivery charge will be confirmed as part of the commission process.
You are responsible for providing an accurate delivery address.
The finished commission will not be dispatched until the balance due has been paid.
11. Forever Memory
Forever Memory is currently in development.
Unless expressly agreed otherwise in the future, Forever Memory is not currently included in, or required for, a Birth Bear commission.
12. Intellectual property
The Brambelo name, branding, website content, photographs, illustrations, designs and other original Brambelo material are protected by applicable intellectual property rights.
Purchasing a Brambelo product does not transfer ownership of those intellectual property rights.
13. Governing law
These Terms & Conditions are governed by the applicable laws of England and Wales.
If you are a consumer living elsewhere in the United Kingdom, you may also have rights under the laws applicable where you live.
Nothing in these terms limits any mandatory consumer protections available to you.
